US v. Earl, No. 12-10169 (9-5-13)(Carr, Sr. D.J., with Reinhardt and M. Smith).


Home may be where the heart is, but if assigned to home confinement by BOP, it isn't where SR starts. The defendant did well at BOP, and then at the half way house. He was then assigned to home confinement by BOP. This confinement or condition meant he was still under BOP, even at home. This matters because later he violates SR. The question was when SR started.
