US v. Rocha-Alvarado, No. 15-10517 (12-12-16)(Restani w/Bea & Ikuta). The 9th affirms a 16 level enhancement to a conviction of illegal reentry after deportation.  The 9th holds the defendant's prior conviction for attempted sexual abuse in the first degree under Ore. Rev. Stat. 163.427(1)(a) qualifies, under a modified categorical approach, as a "crime of violence."
