14-10037 (7-5-16)(McKeown with Thomas; Reinhardt dissenting). Is borrowing a password a computer
crime? If done intentionally and without
authorization, and leading to trade secret theft, then it violates the Computer
Fraud and Abuse Act. Reinhardt,
dissenting, sees a slippery slope from password sharing to criminal acts. He argues that the criminal laws being used
in a civil matter.
